1. Agreement to Terms

By accessing or using the SiteForge website and services at siteforge.agency ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SiteForge builds custom websites for local businesses. Your website is offered as a one-time purchase that includes hosting, security, and maintenance on SiteForge infrastructure. Optional monthly add-on services are available for customers who want ongoing extras such as a custom domain or online booking.

3. Accounts and Registration

When you claim a landing page or sign up for our Service, you agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Pricing and Payments

  • Your website is a one-time payment of $199, which includes hosting, security, and updates. There is no recurring fee for the website itself.
  • Optional add-ons are available: Custom Domain ($10/month), Additional Pages ($29 one-time), and Online Booking ($19/month). One-time add-ons are billed once; monthly add-ons are billed monthly until you cancel.
  • Refunds are governed by our Refund Policy, which includes a 30-day money-back guarantee on your initial purchase.
  • We reserve the right to change the pricing of monthly add-ons with 30 days' notice to affected customers before the change takes effect on their next billing cycle.

5. Cancellation

You may cancel any monthly add-on at any time. When you cancel, that add-on remains active through the end of your current billing period, and you will not be billed again for it. Your website itself has no recurring fee, so it stays live whether or not you use any monthly add-ons. You may request an export of your content at any time. If a refund is issued under our Refund Policy, your site will be taken offline.

6. Content Ownership

  • Your Content: You retain ownership of any text, images, logos, or other materials you provide to us ("Your Content"). By providing Your Content, you grant SiteForge a non-exclusive license to use it solely for the purpose of delivering the Service.
  • Generated Content: Page designs, layouts, and copy created by SiteForge become your property once you claim and pay for your website.
  • SiteForge IP: Templates, code, and infrastructure used to deliver the Service remain the property of SiteForge.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Distribute malware, spam, or harmful content
  • Misrepresent your identity or business
  • Interfere with the operation of the Service

We reserve the right to suspend or terminate accounts that violate these terms.

8. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by circumstances beyond our control, including third-party service outages.

9. Limitation of Liability

To the maximum extent permitted by law, SiteForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless SiteForge, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

11. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
