Terms of Service

1. Agreement to Terms

By accessing or using the SiteForge website and services at siteforge.agency ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SiteForge provides website design, hosting, and management services for local businesses. We create custom landing pages, host them on our infrastructure, and offer ongoing maintenance as part of a monthly or annual subscription.

3. Accounts and Registration

When you claim a landing page or sign up for our Service, you agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Pricing and Payments

• The LaunchPad plan is billed at $79/month (monthly) or $63.25/month (annual, billed annually).
• Optional add-ons (Custom Domain, Additional Pages, Google Business Profile, Online Booking) are billed monthly in addition to the base plan.
• All fees are non-refundable except as required by applicable law.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change takes effect on their next billing cycle.

5. Cancellation

You may cancel your subscription at any time. Upon cancellation, your Service will remain active through the end of your current billing period. After that, your hosted page will be taken offline. You may request an export of your content at any time before or within 30 days after cancellation.

6. Content Ownership

• Your Content: You retain ownership of any text, images, logos, or other materials you provide to us ("Your Content"). By providing Your Content, you grant SiteForge a non-exclusive license to use it solely for the purpose of delivering the Service.
• Generated Content: Landing page designs, layouts, and AI-generated copy created by SiteForge become your property once you claim and pay for your page.
• SiteForge IP: Templates, code, and infrastructure used to deliver the Service remain the property of SiteForge.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Distribute malware, spam, or harmful content
• Misrepresent your identity or business
• Interfere with the operation of the Service

We reserve the right to suspend or terminate accounts that violate these terms.

8. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for downtime caused by circumstances beyond our control, including third-party service outages.

9. Limitation of Liability

To the maximum extent permitted by law, SiteForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless SiteForge, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

11. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
